TERMS OF SERVICE

Welcome to myx4us.com

Please read the following terms and conditions carefully before downloading, registering on, accessing, browsing any content, functionality, services, and payment methods while using the X4US website located at myx4us.com, or the mobile application. Hereinafter collectively, the X4US platforms are run of X4US LLC.

1. Acceptance: By registering on, accessing, browsing, downloading, or using the X4US platform for a specific purpose of any X4US service or when you click to accept the terms of service, you automatically and immediately agree to be bound and abide by all the T&Cs or Privacy Policy. If at any time you do not accept or agree with any of the Terms of Service or do not wish to be bound by the Terms of Service, you may not access, browse or use the X4US Platforms. For more detailed policies surrounding the activity and usage on the Site, please access the designated articles herein.

2. Eligibility:  The X4US Services are not available to persons under the age of 18. If you’re under 18 you may not use this Site or the X4US services. By accepting the T&Cs or by otherwise using the X4US Services on the X4US Platform, you represent and warrant that you are at least 18 years of age or the legal age to form a binding contract and meet all of the foregoing eligibility requirements. 

3. X4US Team: Our Customer Support team is available 24/7 if you have any questions regarding the Site or Terms of Service. Contacting our Customer Support team can be performed by submitting a request here on the website.

The original language of these Terms of Service, as well as all other texts throughout the Site, is English, for the convenient understanding of all.

About X4US

X4US is a technology service and platform provider to permit Buyers and Sellers to connect. Sellers can sign up on the platform and offer their beauty industry items for sale, through auction, by simply listing them. Buyers can sign up for the services if they want to purchase or bid on any of such beauty industry items. Registration is free for all users (Sellers and Buyers). Only registered users may buy and sell on X4US.

Bids on X4US can be offered at a price as low as $1, or sometimes even less than $1 as determined by the Seller. To ensure the security and integrity of all the payments by Buyers and to pay-out funds to Sellers are managed by third-party companies.

We, here in as X4US platform, disclaim all warranties, express or implied, and limit our liability in these Terms. You must access the Services or participation in any auction or bid on the Services at your own risk.

Key Terms to note for easier access to the app

Buyers: Buyers are users who purchase services on X4US.

Sellers: Sellers are third party users who offer products for bidding on X4US.

Orders: Orders are the formal agreement between a Buyer and Seller after a successful purchase from the Seller’s Page.

Custom Orders: Custom Orders are requests made by a Buyer to receive a Custom Offer from a Seller on a particular product.

Disputes: Disputes are disagreements experienced during an order between a Buyer and Seller on X4US.

Payment Services Provider(s): Payment Services Provider(s) process payment services of Buyers and Sellers in connection with the X4US platform. The services are availed concerning:

  • Collection of funds from Buyers in connection with purchases.
  • Remittance and withdrawal of funds to Sellers.
  • Currency exchange services in connection with payments in local currencies.
  • Holding or withdrawal of funds to Sellers with X4US Balance.

X4US Balance: X4US Balance is the aggregated amount of your Revenue as a Seller and/or returned payments from cancelled orders as a Buyer. 

Revenue: Revenue is the money that Sellers earn from completed Sells and can either withdraw or use to purchase on X4US, subject to these Terms.

Fees and Payments Information:

Users undertake a set of behavior rules and guidelines in addition to these Terms of Service to comply with X4US Community Standards, which apply to the X4US community and marketplace. These terms get updated from time to time for the necessary improvement of the X4US platform.

BOTH PARTIES (SELLERS AND BUYERS):

X4US partners with Payment Services Providers to collect payments from Buyers, transfer payments from Buyers to Sellers, and holding funds in connection with X4US Balances. All payments services associated with the withdrawal of funds on the X4US platform are performed by X4US Payment Services Providers.

The X4US Balance of Sellers and Buyers is calculated from its US$ value. Users can opt to display it in US$ currency by changing their selected displayed currency. If a user’s local currency is other than US$, the X4US Balance Amount may change daily in accordance with the exchange rate fluctuations. For maintaining the same US$ value, the balance may include conversion fees. Users always have the option to withdraw Revenues in US$.

SELLERS

In order to use certain Services (for example, to create Bids and Pay Now on X4US), you’ll have to register with X4US providing certain information that we deem relevant. Sellers create Bids and Pay Now on X4US to allow Buyers to purchase their services. In addition to the Products you may also propose custom deals to Buyers. Seller can sell their items through an auction or as a "Pay Now" sale. You can list a product on a binding offer to sell at a remarked price, as low as $1 or any higher amount. If the Buyers wins the auction or opts to purchase an item through “Pay Now” sale, they will have to pay the winning bid amount or the certain “Pay Now” price to deem the sale as complete and get confirmation from X4US.

Selling a product successfully accredits your account with a net revenue of the purchase amount. All payments and refunds facilitated by the Services are processed by X4US Payment Services Providers, you agree that X4US does so in association with Payment Services Providers, on your behalf (as stated above in these terms). Sellers may withdraw their revenues using one of X4US Withdrawal (see Withdrawal Section below regarding payment terms). Gained Revenues are only made available for withdrawal from the Revenue page following a safety clearance period of days after the order is marked as complete. If in case an order get canceled, for any reason, the funds will be returned to the Buyer’s Account. Users may not offer or accept payments using any method other than placing an order through myx4us.com. 

Due to security concerns or improper behavior reported by Buyers, or for linking multiple X4US accounts to a single withdrawal provider, X4US may temporarily disable a Seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. You may not create more than one Seller account on X4US. We care about your privacy. You can read our Privacy Policy here. The Privacy Policy is a part of these Terms of Service and incorporated herein by reference.

Taxes: Sellers are responsible for paying any direct or indirect tax or taxes, including any value added taxes (VAT), goods and services taxes (GST) or otherwise, which may apply to them depending on residency or location. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The price shown on the Product page is inclusive of all such taxes and charges that may apply to the Sellers.

Appointment as Limited Payment Collection Agent: Seller hereby appoints X4US as Seller’s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from Buyer, and remitting those payments to Seller. Seller agrees that payment from Buyer to X4US shall be considered the same as a payment made directly to Seller. Buyer’s payment obligation to Seller will be satisfied upon receipt of payment by X4US (or its Payment Services Provider, as applicable), and X4US (via its Payment Services Provider, as applicable) is responsible for remitting the funds to the Seller in the manner described in these Terms of Service. If X4US (via Payment Services Provider) does not remit any such amounts to Seller, the Seller will have recourse only against X4US and not the Buyer directly. Seller agrees that X4US may describe or otherwise reflect the terms contained herein in any terms of service, receipts, disclosures, or notices including, but not limited to, receipts provided to Buyers that X4US may deem necessary or prudent.

Illegal or Fraudulent Service Policy: Bids/Products and/or users may be removed by X4US from the Site for violations of these Terms of Service and/or our Community Standards, which may include (but are not limited to) the following violations and/or materials. Also, Copyright Infringement, Trademark Infringement, and violation of a third party's terms of service reported through our Policy are found here.

  • Adult oriented services, Pornographic, Inappropriate/Obscene
  • Intentional copies of Bids
  • Spam, nonsense, or violent or deceptive
  • Bids/Sales Bids misleading to Buyers or others
  • Reselling of regulated goods
  • Services that extend beyond 30 days of service duration
  • Exceedingly low quality Bids
  • Statements on the Product Page that undermine or circumvent these Terms of Service is prohibited.
  • Promoting X4US and/or X4US through activities that are prohibited by any laws, regulations, and/or third parties' terms of service, as well as through any marketing activity that negatively affects our relationships with our users or partners.
  • Bids or messages containing websites promoting content, which violates X4US Terms of Service and/or our Community Standards, will be removed.

Bids that are removed for violations mentioned above, may result in:

  • Suspension of the Seller’s account.
  • Cannot eligible to be restored or edited.

Also, bids may be removed due to poor performance and/or user misconduct. Statements on the Product Page that undermine or circumvent these Terms of Service is prohibited.

Listing Products: Bids are required to have an appropriate Bid image related to the service offered. An option to upload two additional Bid images are available to all Sellers. Sellers must deliver the same quality of service as shown on their product images. Recurring deliveries that don’t match the quality shown on the product images may lead to the Seller’s account losing Seller status or becoming permanently disabled.

Products may contain an approved products Video uploaded through the product management tools available on X4US.

Seller Features: X4US Sellers have access to several exclusive features that help customize the way their services can be offered.

Custom Offer: Sellers can also send Custom Offers addressing specific requirements of a Buyer. Services provided through Custom Offers may not violate X4US Terms of Service.

Shipping Physical Deliverables: When a Buyer orders a product, the Seller is notified by email as well as notifications on the site while logged into the account. Sellers are required to meet the delivery time they specified when creating their orders. Failing to do so will allow the Buyer to cancel the Order when an Order is marked as late and may harm the Seller's status.

X4US does not handle or guarantee shipping, tracking, quality, and condition of items or their delivery and shall not be responsible or liable for any damages or other problems resulting from shipping. Sellers may decide to add shipping charges. Can add shipping charges for local shipping (within the same country) and international shipping (anywhere else). 

Shipping costs added to order only pertains to the cost sellers require to ship physical items to Buyers. Sellers are responsible for all shipping arrangements once the buyer provides the shipping address. A tracking number is a great way to avoid disputes related to shipping. We require entering the tracking number if available in the Order Page when delivering your merchandise.

Important: Buyers who purchase products that require physical delivery, will be asked to provide a shipping address.

Withdrawing Revenues: To withdraw your revenue, you must have an account with at least one of X4US Payment Service Providers for the withdrawal methods and all payment services. All payment services, including withdrawal services will be provided by X4US Payment Services Provider. A Payment Service Provider withdrawal account can be associated with only one X4US profile.

Revenues are only made available for withdrawal from the “Cash Out” page following a safety clearance period of days after the order is marked as complete. To withdraw your available revenue, you must click on the designated withdrawal provider to initiate the withdrawal process. Withdrawal fees vary depending on the withdrawal method. (* Additional fees may apply based on your location and currency.)

Note: Withdrawals are final and cannot be undone. We will not be able to reverse this process once it has begun. 

Your X4US Balance is always derived from its US$ value and, therefore, the local currency amount of your X4US Balance may change daily in accordance with exchange rates fluctuations and also includes conversion fees. Sellers always have the option to withdraw Revenues in US$.

Seller fees:

Your earnings are equal to the Listing fees minus the Seller fee,processing payment Seller and shipping fee.If you select to offer free shipping these fees are charged to the seller when the sale has been successfully completed. 0% listing fee.A minimum of 20% for Platinum sellers and 22% for Diamond Seller.Tranactions and Payment fees:X4US incurs fees related to payment processing and withdraws out of our system by our financial service partners.These service fees are charged to the sellers.Processing payment fee:X4US charges a flat rate of $2.00.

BUYERS

In order to use certain Services (for example, to create Bids and Pay Now on X4US), you’ll have to register with X4US providing certain information that we deem relevant. Buying user may not offer direct payments to Sellers using payment systems outside of the X4US platform. X4US auctions are real, and any bids placed to bind offers to purchase the beauty item on the Listing. If you as a buyer win a bid, you will have to pay for the same.  

X4US serves as Seller’s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from Buyer, and remitting those payments to Seller. Buyer’s payment obligation to Seller will be satisfied upon receipt of payment by X4US (or its Payment Services Provider, as applicable), and X4US (via its Payment Service Provider, as applicable) is responsible for remitting the funds to the Seller in the manner described in these Terms of Service. In the event that X4US (via Payment Services Provider) does not remit any such amounts to Seller, the Seller will have recourse only against X4US and not the Buyer directly.

Payment: X4US partners with Payment Services Providers for purposes of collecting all payments from Buyers, transferring such payments from Buyers to Sellers, and holding funds in connection with X4US Balances. Also, Service fees are added at the time of purchase where a Buyer can review and accept the total amount requested to pay. These fees include administrative fees. You may not offer Sellers to pay or make payment using any method other than through the myx4us site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support here. 

All payments services in connection with the collection of funds on the X4US platform are performed by X4US Payment Services Providers. In most locations, purchases on X4US can be made by using one of the following payment methods: Stripe and PayPal.

Payment Privacy: By using any payment method and/or providing payment details for making purchases on X4US, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method(s); (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on X4US; and (d) such actions do not violate any applicable law. 

Payment Services Providers may collect important information as necessary for proposes of processing withdrawal payments. X4US is not exposed to the payment information provided to Payment Services Providers. Any personal information that you provide to us is subject to the privacy policy applicable to the Payment Service Provider. You may understand that by using the Services allow to the collection and use (Please see our Privacy Policy for more information here) of this information. 

To protect against fraud, unauthorized transactions (such as money laundering), claims or other liabilities, payment information in connection with withdrawals is collected by either X4US or X4US Payment Services Providers.

Local Currencies: Buyer may make payments for the purchase made on X4US in several different currencies. You can edit X4US payment settlings to enable paying in different currencies otherwise unless stated, you will be charged in the currency displayed on the payment page. All currency exchange services in connection with payments and withdrawals in local currencies are performed by X4US Payment Services Providers. 

However, if in case, some of our payment methods does not support certain currencies, you will be charged in US$ even if the price is displayed on the payment page is in another currency. We recall and clearly disclose the actually charged amount before you complete the payment. You can change the visible currency to US$ or any other from settling to make sure the right charges are shown.  

Buyers shall note that all prices on X4US are derived always from their original US$ price and, therefore, non-US$ currency prices may change daily in accordance with exchange rates fluctuations. It will also include conversion fees. Buyers always have the option to pay in US$ by changing their selected displayed currency. 

If you paid for an Order in a currency other than US$ and your Order was later cancelled for any reason, the amount returned to your X4US Balance would be based on the exchange rate as of the date of cancellation. Therefore, the returned amount may vary from the paid amount in local currency terms, while always maintaining the same US$ value. 

Taxes: Buyers may be charged with indirect taxes (such as Sales Tax, VAT or GST) depending on their residency, location and any applicable law, in addition to the price shown on the site, and, in any event, any such taxes will always be displayed to the Buyer before payment. 

Buyers agree that they are responsible to comply with all tax requirements applicable to them, including but not limited to any obligation to deduct or withhold taxes. It is hereby clarified that all prices and fees that appear on the Site are the net amounts that will be paid following any direct or indirect taxes, levy, withholding tax and/or deductions.

Orders Disputes and Cancellations: The buyers need to note when you make a purchase via the X4US Services, you are buying directly from the applicable Seller of the item, not from X4US. Any exchange of information during the transaction of Services or provided detail regarding the beauty product, including but not limited to, product descriptions, warranties offered, or any other terms mentioned in the Listing are between you and the applicable Seller. We recommend and insist Buyers to review and familiarize yourself with all terms of sale provided by the Seller before using any X4US service for the same.  

If in case any conflicts, Buyers and Sellers may first try and settle amongst themselves. For any reason Resolution Centre fails to encounter the situation or users notices non-permitted activities on the site, users may contact the X4US Customer Support department for instant assistance here.

Privacy (Handling Orders): Every small information that you provided us is subjected to our Privacy Policy. The policy governs our collection and use of your Personal Information. It is only collected by Buyer’s consent and agree to the Terms and conditions as outlined in the Privacy Policy. Apart from that, users are responsible for scanning all transferred files for viruses and malware. X4US will not be held responsible for any damages, which might occur due to site usage, use of content or files transferred.

Buyer/Seller Feedback (Reviews): User may submit reviews regarding the Sellers they have used the services of. Buyers are encouraged to make us of the rating and feedback features for sharing your experience with the Seller, product, and the service. Any other use of the feedback system is prohibited. The purpose of feedback is to verify Seller’s reliability to other Buyers and also to X4US. In case negative feedbacks Seller’s account may get temporarily or permanently disabled. Users are requested not to submit reviews to manipulate another communicate to the Seller any concerns experienced during their active order in regards to the service provided by the Seller.

ORDER CANCELLATIONS 

X4US encourages Buyers and Sellers to resolve service disputes including order cancellation mutually using the Resolution Center. Order cancellations can be performed on X4US, when eligible, by Customer Support or through the Resolution Center per order. The eligibility for cancellation request to X4US will depend on a several number of factors, including violations of our Terms of Service and/or our Community Standards, general misconduct, and improper usage of the X4US delivery system. See below for Order specific eligibility. 

Completed orders (or, where applicable, completed milestones) may be cancelled, upon review of our Customer Support team, up to 7 days after the order. Please be advised that orders cannot be partially cancelled (i.e. we can only cancel the entire order when it is justified). In rare circumstances where we find it appropriate, our Customer Support team may cancel a completed order even after 14 days have passed from its completion. In such cases, the amounts paid for the cancelled order will be returned to the Buyer’s account and will be deducted from the Seller’s X4US Balance or, if there are no sufficient amounts in the Seller’s X4US Balance, from future revenues of such Seller. 

Orders are not eligible to be cancelled based on the quality of service/materials delivered by the Seller if the service was rendered as described in the Order Page. Buyers must use X4US Resolution Center to address their concerns and desired resolution related to the service provided by their Seller prior to contacting Customer Support. Customer Support will not take any action against Orders where the Buyers failed to inform their Seller of issues related to the Seller’s service and will allow Sellers to provide a resolution first. This does not include non-permitted usage of X4US. 

Any non-permitted usage of X4US encountered during an Order, after being reviewed by our Customer Support team, may result in the cancellation of the order. This includes, but not limited to, harassment, unlawful behavior, or any violations of X4US Terms of Service. 

X4US Customer Support will cancel certain orders based on, but not limited to, the following reasons:  Active Orders (after the Buyer submits their payments and before the Seller delivers on X4US) (i) the Seller is late and unresponsive for more than 24 hours while the order is marked as Late; (ii) the user is no longer an active X4US user due to Terms of Service violations or closure of their account; Delivered Orders (after the Seller clicks Pay Now and before the order is marked as complete- the order surpassed payment procedure) (i) the Seller delivers no merchandise related to the agreed upon order requirements (Note: Subjectivity of the materials in question will be reviewed by our Customer Support team); (ii) the Seller requests additional payments, on or off the X4US platform, by withholding the final delivery of services directly related to the agreed requirements; Completed Orders (after the order is marked as complete and before the 14 day limitation) (i) X4US Customer Support will review cases of Order delivery manipulation that prevents Buyers and Sellers from fully utilizing our Resolution Center that enabled the order to be marked as complete. 

X4US, through its Payment Services Providers, reserves the right to cancel orders or place funds on hold for any suspected fraudulent transactions made on the Site. All transfer and assignment of the Buyer shall be subject to full payment and the delivery may not be used if payment is cancelled for any reason. If an order is cancelled (for any reason), the funds paid will be returned to the Buyer’s account. 

Refunds: Refund payments requested on X4US app doesn’t get transacted back to the Buyer’s payment provider. Funds from order cancellations are returned to the Buyer's account Balance and are available for future purchases on X4US. Also, we return service fees to your account Balance once an order is cancelled. In any event, if the service fees were not returned to your account Balance following an order cancelation, such service fees’ amount will be exempted from your next purchase on X4US. 

Deposit refunds (i.e. refunds directly to your payment provider) can be performed by our Customer Support team, based on the Order’s original payment amount and currency. To prevent fraud and abuse, we limit the total amount of times users can request a payment provider refund, which is subject to review by our Customer Support team. Such refunds may subject to an additional fee. 

User Conduct and Protection 

X4US enables users to Bid, Buy, Sell, and Purchase nearly any beauty product they need at an unbeatable value. Services offered on X4US reflect the diversity of an expanding Beauty Industry’s economy. Members of the X4US community has the opportunity to communicate and engage through orders or our Social Channels. X4US believes in maintaining a friendly, community-spirited, and professional environment. We expect our users to keep to that spirit while participating in any activity or extensions of X4US. This section relates to the expected conduct users should adhere to while interacting with each other on X4US.  

To protect our users' privacy, user identities are kept anonymous. Requesting or providing Email addresses, Skype/IM usernames, telephone numbers or any other personal contact details to communicate outside of X4US in order to circumvent or abuse the X4US messaging system or X4US platform is not permitted. Any necessary exchange of personal information required to continue a service may be exchanged within the message page. X4US does not provide any guarantee of the level of service offered to Buyers. You may use the dispute resolution tools provided to you in the Order Page. X4US does not provide protection for users who interact outside of the X4US platform. All information and file exchanges must be performed exclusively on X4US platform. Any sort of rude, abusive, improper language, or violent messages will not be tolerated by the platform and may result in an account warning or the suspension/removal of your account. X4US is open to everyone who respects the terms and services.  

Discrimination against a community member based on gender, race, age, religious affiliation, sexual preference or otherwise is not acceptable and may result in the suspension/removal of your account. Users may not submit proposals or solicit parties introduced through X4US to contract, engage with, or pay outside of X4US. 

To report a violation of our Terms of Service and/or our Community Standards, User Misconduct, or inquiries regarding your account, please contact our Customer Support team here.

Orders: Users with the intention to defame competing Sellers by ordering from competing services will have their reviews removed or further account status related actions determined by review by our Trust & Safety team. Users are to refrain from spamming or soliciting previous Buyers or Sellers to pursue removing/modifying or cancelling orders that do not align on Order Cancellation or Feedback policies. X4US reviews cases of payment provider chargebacks and disputes on behalf of Sellers. Although results vary per case due to each chargeback reason, we work hard on resolving disputes in the Seller’s favor. If the chargeback case allows, X4US (or one of X4US Payment Services Providers) will return parts or full revenue back to Sellers, otherwise the chargeback amount will be borne by the Seller. 

Reporting Violations: If you come across any content that may violate our Terms of Service and/or our Community Standards, you should report it to us through the appropriate channels created to handle those issues as outlined in our Terms of Service. All cases are reviewed by our Trust & Safety team. To protect individual privacy, the results of the investigation are not shared. You can review our Privacy Policy for more information. 

Violations: Users may receive a warning to their account for violations of our Terms of Service and/or our Community Standards or any user misconduct reported to our Trust and Safety team. A warning will be sent to the user's email address and will be displayed for such user on the Site. Warnings do not limit account activity, but can lead to your account losing Seller statuses or becoming permanently disabled based on the severity of the violation. 

Abuse and Spam 

The goal of X4US is to provide the best service possible for an enjoyable online bidding experience. This Acceptable Use Policy (“AUP” or “Policy”) is designed for all of our users. Violation of this Policy may result in suspension or cancellation of X4US services and themselves will be responsible for the same. Using X4US platform automatically constitutes acceptance and acknowledgement of this Acceptable Use Policy. 

Multiple Accounts - To prevent fraud and abuse, users are limited to one active account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the X4US community will be disabled. Mass account creation may result in disabling of all related accounts. Note: any violations of X4US Terms of Service and/or our Community Standards is a cause for permanent suspension of all accounts. 

Targeted Abuse - We do not tolerate users who engage in targeted abuse or harassment towards other users on X4US. This includes creating new multiple accounts to harass members through our message or ordering system.  

Selling Accounts - You may not buy or sell X4US accounts. 

Non-Permitted Usage 

Any action performed by the users against the below-mentioned terms will be considered as a violation of policy. Strict actions will be taken for the particular user account violating them, once reviewed by our support team. No user on any conditions will be permitted for it on the X4US platform. 

Adult Services & Pornography - X4US does not allow any exchange of adult oriented or pornographic materials and services. Inappropriate Behavior & Language - Communication on X4US should be friendly, constructive, and professional. X4US condemns bullying, harassment, and hate speech towards others. We allow users a medium for which messages are exchanged between individuals, a system to rate orders, and to engage on larger platforms such as Social Media pages.  

Phishing and Spam - Members’ security is a top priority. Any attempts to publish or send malicious content with the intent to compromise another member’s account or computer environment is strictly prohibited. Please respect our members privacy by not contacting them with offers, questions, suggestions or anything which is not directly related to their or orders. 

Privacy & Identity - You may not publish or post other people's private and confidential information. Any exchange of personal information required for the completion of a service must be provided in the Order Page. Sellers further confirm that whatever information they receive from the Buyer, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the work to the Buyer. Any users who engage and communicate off of X4US will not be protected by our Terms of Service. 

Authentic X4US Profile - You may not create a false identity on X4US, misrepresent your identity, create a X4US profile for anyone other than yourself (a real person), or use or attempt to use another user’s account or information; Your profile information, including your description, skills, location, etc., while may be kept anonymous, must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. X4US reserves the right to require users to go through a verification process in order to use the Site (whether by using ID, phone, camera, etc.).  

Fraud / Unlawful Use - You may not use X4US for any unlawful purposes or to conduct illegal activities.

PROPRIETARY RESTRICTIONS 

The Site, including its general layout, design and content, is exclusively owned by X4US and protected by copyright and trademark law. X4US ® are all registered trademarks owned exclusively by X4US. Users have no right, and specifically agree not to do the following with respect to the Site or any part, component or extension of the Site (including its mobile applications): (i) copy, transfer, adapt, modify, distribute or reproduce it, in any manner; (ii) reverse assemble, decompile, reverse engineer or otherwise attempt to derive its source code, underlying ideas, algorithms, structure or organization; (iii) modify or create derivative works; (iv) remove any copyright notice, identification or any other proprietary notices, or; (v) use the Site in any manner that could damage, disable, overburden or impair the Site, or interfere with any other users’ enjoyment of the Site. Users also agree not to permit or authorize anyone else to do any of the foregoing. 

FEEDBACK RIGHTS 

To the extent that you provide X4US with any comments, suggestions or other feedback regarding the X4US platform or the Site as a whole, as well as other X4US products or services (collectively, the “Feedback”), you will be deemed to have granted X4US an exclusive, royalty-free, fully paid up, perpetual, irrevocable, worldwide ownership rights in the Feedback. X4US is under no obligation to implement any Feedback it may receive from users. 

CONFIDENTIALITY 

Sellers should recognize that there might be a need for Buyers to disclose certain confidential information to be used by Sellers for the purpose of delivering the ordered work, and to protect such confidential information from unauthorized use and disclosure. Therefore, Sellers agree to treat any information received from Buyers as highly sensitive, top secret and classified material. Without derogating from the generality of the above, Sellers specifically agree to (i) maintain all such information in strict confidence; (ii) not disclose the information to any third parties; (iii) not use the information for any purpose except for delivering the ordered work; and (vi) not to copy or reproduce any of the information without the Buyer’s permission. 

General Terms  

X4US reserves the right to put any account on hold or permanently disable accounts due to breach of these Terms of Service and/or our Community Standards or due to any illegal or inappropriate use of the Site or services. Violation of X4US Terms of Service and policy may get your account disabled permanently. Users with disabled accounts will not be able to sell or buy on X4US. Users who have violated our Terms of Service and had their account disabled may contact our Customer Support team for more information surrounding the violation and status of the account. Users have the option to enable account Security features to protect their account from any unauthorized usage. Users must be able to verify their account ownership through Customer Support by providing materials that prove ownership of that account. Sellers will be able to withdraw their revenues from disabled accounts after a safety period of 90 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account and subject to X4US approval. Disputes should be handled using X4US dispute resolution tools ('Resolution Center' on the help page) or by contacting X4US Customer Support. X4US may make changes to its Terms of Service from time to time. When these changes are made, X4US will make a new copy of the terms of service available on this page. You understand and agree that if you use X4US after the date on which the Terms of Service have changed, X4US will treat your use as acceptance of the updated Terms of Service.

User Generated Content: User Generated Content ("UGC") refers to the content added by users as opposed to content created by the Site. All content uploaded to X4US by our users (Buyers and Sellers) is User Generated Content. X4US does not check user uploaded/created content for appropriateness, violations of copyright, trademarks, other rights, or violations. We invite everyone to report violations together with proof of ownership as appropriate. Reported violating content may be removed or disabled.  

Furthermore, X4US is not responsible for the content, quality, or the level of service provided by the Sellers (even if they are Platinum Sellers, Diamond Sellers, or otherwise). We provide no warranty with respect to the Bids, their delivery, any communications between Buyers and Sellers. By offering a service, the Seller undertakes that he/she has sufficient permissions, rights, and/or licenses to provide, sell, or resell the service that is offered on X4US. Users (both Buyers and Sellers) agree that unless they explicitly indicate otherwise, the content users voluntarily create/upload to X4US, including Bid texts, photos, videos, usernames, user photos, user videos and any other information, including the display of delivered work, may be used by X4US for no consideration for marketing and/or other purposes. 

Disclaimer of Warranties 

THE X4US PLATFORM (SITE OR APP), ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. The USE OF THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. NEITHER X4US NOR ANY PERSON ASSOCIATED WITH X4US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE WEBSITE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. THE OFFICIAL TEXT IS THE ENGLISH VERSION OF THE SITE. IN NO EVENT WILL X4US, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE TERM “AFFILIATE” REFERRED TO HEREIN, IS AN ENTITY THAT, DIRECTLY OR INDIRECTLY, CONTROLS, OR IS UNDER THE CONTROL OF, OR IS UNDER COMMON CONTROL WITH X4US, WHERE CONTROL MEANS HAVING MORE THAN FIFTY PERCENT (50%) VOTING STOCK OR OTHER OWNERSHIP INTEREST OR THE MAJORITY OF VOTING RIGHTS OF SUCH ENTITY.
